WINEonROUTE is a business in the beverage industry that sells wine and other alcoholic beverages to the public on an E-commerce platform.

Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the WINEonROUTE bank account, the details of which will be provided on request.

Card transactions will be acquired for WINEonROUTE via PayGate (Pty.) Ltd., who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no card details are stored on the website. Users may go to www.paygate.co.za

to view their security certificate and security policy. WINEonROUTE will store customer details separately from card details entered by the client on DPO PayGate’s secure site.

The cardholder must choose South Africa as the merchant outlet country at the time of presenting payment options. The transaction currency is South African Rand (ZAR).

WINEonROUTE takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

This website is governed by the laws of South Africa and WINEonROUTE chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process.

WINEonROUTE may, in its sole discretion, change this agreement or any part thereof at any time without notice.

This website is based in South Africa trading as WINEonROUTE and with registration number 2015/426617/07.

TERMINATION
Notwithstanding any of these terms and conditions, WINEonROUTE reserves the right, without notice and in its sole discretion, to terminate your license to use this site, and to block or prevent future access to and use of this site.

USER’S LIABILITY TO WINEonROUTE
In the event that WINEonROUTE takes action against you for breach of any terms of use, you agree to reimburse WINEonROUTE for all legal costs, including tracing fees and collection commission, on a scale as between attorney and own client.

LIMITATION ON LIABILITY WINEonROUTE has taken reasonable steps as far is possible, to ensure the accuracy and completeness of the content shown on this site, to ensure that the user doesn’t suffer any loss or damages as a result of the use of this site.

UNDER NO CIRCUMSTANCES, INCLUDING WITHOUT LIMITATION NEGLIGENCE, SHALL WINEonROUTE OR ITS PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, TRANSMITTING, OR DISTRIBUTING wineonroute.co.za OR RELATED SERVICES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM OR IN CONNECTION WITH THE USE OR INABILITY TO USE WINEonROUTE OR ANY CONTENT PROVIDED BY OR THROUGH THIS SITE, OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, OR OTHER INFORMATION THAT IS SENT OR RECEIVED, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, USE, DATA OR OTHER INTANGIBLES, EVEN IF WINEonROUTE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR LIABILITY TO YOU IN CONNECTION WITH ANY ORDER WILL NOT EXCEED THE TOTAL PRICE CHARGED FOR THE RELEVANT ITEMS AND THE SHIPPING COSTS.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, in such jurisdictions, liability is limited to the fullest extent permitted by law.

INDEMNIFICATION
You shall remain solely liable for the content of any messages or other information you upload or transmit to WINEonROUTE. You agree to indemnify and hold harmless WINEonROUT from any claim, action, demand, loss or damages (including attorneys’ fees) made or incurred by any third party arising out of or relating to your conduct, your violation of these terms and conditions, or your violation of any rights of a third party.

PROMOTION
The special offer of ‘buy 12 get one free’ only applies to mixed cases of 12 bottles of wine from a selections of cultivars. This does not apply if you buy less or more than 12 bottles from the same cultivar. The free bottle will be the least expensive of the selection.

RETRUNS AND CANCELLATIONS

• The provision of goods and services by WINEonROUTE is subject to availability. In cases of unavailability, WINEonROUTE will refund the client in full within 30 days.
• If for any reason you are not satisfied with any product ordered via the website, you may return such product.
• WINEonROUTE will not accept any return unless the product that you wish to return:
  • Is returned in its original packaging;
  • Is sealed effectively to allow for return shipping without compromising the content;
  • Is shipped within fourteen (14) days of the date that you received delivery of the product;
  • Is, where you are returning a number of Products that were received as part of the same order, returned in one single shipment.
• Our refund and returns policy last 14 days. If 14 days have passed since your purchase and you wish to return your purchase, please contact us on +27 82 789 4386 or via email orders@wineonroute.co.za. 

• For cancelations of your order: In the event that the goods have already been dispatched at the date of receipt of your cancellation of the order, you must return the goods to us, and we will refund you with the price of the goods within 30 days, beginning with the day on which notice of cancellation was given. If you do not return the goods or fail to make them available for collection within 30 days of your order, you will be deemed to have accepted the goods and will be charged for your order.
• Should the wine be found faulty, please contact us within 14 days of receipt of your order.
• Cancelled and/or returned orders are subject to the delivery charges. These charges must be paid by you. However, if the wine is found to be faulty in any respect, we will not expect you to pay the courier charges.

DELIVERIES

• Subject to availability and receipt of payment, requests will be processed within seven days and delivery confirmed by way of courier.
• WINEonROUTE do our best to secure delivery within a reasonable number of days of your order but will not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control.
• All goods must be signed for on delivery by an adult aged 18 years or over. If no one of that age is at the address when the delivery is attempted the goods will be retained by the courier, in which case notification of the attempted delivery will be given. The courier service will subsequently arrange a suitable date and time for delivery.

RESTRICTIONS ON SALES

• The offering on this website is available to South African clients only.
• Wine is not sold to persons under the age of eighteen (18) years. For this reason, we may refuse an order at our discretion and orders may not be transferred from the customer to any other person.

AGREEMENTS OF SALE
Placing an item in a shopping basket without completing the purchase cycle does not:

• constitute an agreement of sale between WINEonROUTE and users cannot hold WINEonROUTE liable if such items are not available when the purchase cycle is completed later; and/or
• constitute an order for such an item; and
• WINEonROUTE may remove such an item from the shopping basket or wishlist if no stock is available.
• An agreement of sale between WINEonROUTE and a user only comes into effect if and when:
  • A credit card authorisation is received from the issuing bank; or
  • The user has enough Coupons to pay for the order and this payment option was selected.
• WINEonROUTE reserves the right to refuse to accept and/or execute an order without giving any reasons. WINEonROUTE also reserves the right to cancel orders in whole or in part as circumstances dictate. WINEonROUTE shall only be liable to refund monies already paid by the user.
• WINEonROUTE shall take all reasonable efforts to maintain correct prices. However, should errors occur and items are offered at incorrect prices, WINEonROUTE will not be obliged to sell goods at such incorrect prices and shall only be liable to refund monies paid.

REFUNDS
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 30 days.

Late or missing refunds
If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted.

Sale items
Only regular priced items may be refunded. Sale items cannot be refunded.

Exchanges
We only replace items if they are defective or damaged.
